MOUNT WASHINGTON -- Attorney Lori Casey was upfront with the jury panel.

There are certain things you can't say in society without facing the consequences.

She admitted her client, Nicholas Bain, made an immature statement to his mother in mid-September 2013.

During a heated argument over a doctor's excuse note to miss school, Bain told his mother that he could just go and shoot up Old Mill Elementary School.

But Casey argued to the jury that it did not go any further and the 18-year-old teen did not deserve to go to prison.
