SHEPHERDSVILLE — Magistrate Buddy Shepherd was concerned the last time officials had to deal with what to do with overweight trucks using county roads.
Without some type of permission from Bullitt Fiscal Court, overweight vehicles are not allowed.
Last year, the county adopted a permit process where companies could receive permission if they promised to make any repairs.
On several occasions, however, the damage was done and the responsible parties were gone.
Deputy County Judge Billy Roy Shepherd said he had five or six pending permit applications and he didn’t know if Bullitt Fiscal Court wanted him to grant them or wait.
County attorney Walter Sholar said the court members can pass agreements but he strongly urged them to make the process a very strong one.
For Buddy Shepherd, he knew there would be problems when the county did not require a bond to cover the repair costs.
One logger in the area suggested that Weird Road was already damaged before his company started to use it. He offered to pay half the repair cost if the other company paid its share.
He suggested road foreman Jimmy Stivers inspect the road prior to any work being done. He also said that in lieu of a bond, he had insurance coverage of $1 million that should handle the situation.
Sholar agreed that Stivers be involved and the foreman said he does look at each road before work begins.
He said there was no damage to that road prior to the logging trucks using it.
The county’s transportation committee took up the matter and directed the county attorney’s office to draft to cover the entire cost of the repairs, as well as an administrative fee.
Stivers recommended the permit application have enough information to track down the companies if they decide to leave quickly.
The repair costs just to resurface are running $50,000 a mile.
He supported having a bond in place.
Assistant county attorney Rob Flaherty said the county could require a bond, a letter of credit from a bank and he would research the insurance policy proposal.
Often times, the county won’t know about overweight vehicles using the roads until it happens. Sholar said residents will then begin calling county officials.
The draft proposal would need ratification from the court members to become effective.
